Terms of Service

By downloading, installing, accessing, or using the VKX Wallet mobile application, web interface (wallet.vkxtech.com.br), or related services, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease accessing or using VKX Wallet.

VKX Wallet is strictly non-custodial software.

• Sole Control: You maintain sole control over your private keys, seed phrases (BIP-39 12 words), and digital assets.
• No Custody or Access: VKX Technologies does not store, transmit, process, or possess your seed phrases, private keys, or passwords. We cannot access your wallet or recover lost keys.
• User Responsibility: You are exclusively responsible for maintaining the confidentiality and backup of your seed phrase and securing your device with local PIN and biometrics.
• Irreversibility: Transactions executed on blockchain networks are final and irreversible. VKX Technologies cannot pause, cancel, or refund any transaction.

VKX Wallet integrates third-party services to enhance user experience, including fiat-to-crypto and crypto-to-fiat payment processing, decentralized exchange aggregators, and RPC node providers.

• Transak Integration: Fiat-to-crypto purchasing and sell-to-fiat functionalities within VKX Wallet are facilitated by Transak (Transak Limited and its global operating entities).
• Independent Relationship: When you purchase or sell cryptocurrencies using Transak inside VKX Wallet, you enter into a direct contractual relationship with Transak. VKX Technologies is not a payment gateway, financial institution, money transmitter, or fiat custodian.
• Compliance & KYC: Transak handles all identity verification (KYC/KYB), anti-money laundering (AML) checks, and banking operations under its own Terms of Use and Privacy Policy.
• Disclaimer: VKX Technologies is not responsible for Transak’s service uptime, exchange rates, banking fees, account verifications, or transaction processing times.

Transacting in cryptocurrencies and interacting with blockchain protocols involves substantial financial and operational risks:

• Market Volatility: Digital asset prices can fluctuate drastically. You accept all risks of financial loss.
• Network Fees & Gas: Blockchain networks require gas fees (e.g., BNB, ETH, MATIC) to process transactions. VKX Wallet features like "Gas Shield" sponsor or optimize fees where available, but underlying network congestion remains outside our control.
• Smart Contract Risk: Interacting with smart contracts, swap protocols, or decentralized applications (dApps) carries risks of code vulnerabilities or protocol exploits.
• Experimental Technologies: VKX Wallet features Post-Quantum Cryptography (PQC) attestation layers and Vault mechanisms designed to enhance security, provided on an "as-is" technical basis.

You represent and warrant that you are at least 18 years of age or the legal age of majority in your jurisdiction.

You agree NOT to use VKX Wallet to:

• Engage in illegal gambling, money laundering, terrorism financing, or fraudulent activities.
• Violate international sanctions or trade restrictions imposed by OFAC, the United Nations, European Union, or United Kingdom.
• Interfere with, disable, or exploit the VKX Wallet software, APIs, or infrastructure.

VKX Technologies reserves the right to restrict access to centralized API endpoints or relayer servers for addresses flagged for illicit activity.

All rights, titles, and interests in and to VKX Wallet—including code, user interfaces, branding, logos, graphics, and trademarks—are the exclusive intellectual property of VKX Technologies and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

VKX Wallet, its AI Copilot assistant, portfolio telemetry, and promotional materials provide technical tools and informational data only. Nothing contained in VKX Wallet constitutes investment, financial, legal, or tax advice. You should consult a qualified professional before making financial decisions.

VKX WALLET IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VKX TECHNOLOGIES AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR DIGITAL ASSETS RESULTING FROM YOUR USE OF THE APPLICATION.

You agree to defend, indemnify, and hold harmless VKX Technologies and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your violation of these Terms or applicable law.

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the domicile of VKX Technologies.
